This agreement is signed between YAŞMAK TURİZM VE TİCARET A.Ş (hereinafter referred to as YAŞMAK GROUP HOTELS), located at the address Ebu Suud Caddesi No:16-20 Sirkeci/Fatih/Istanbul, and the individual who has logged in to the website www.thesoulhotel.com and completed a reservation procedure (hereinafter referred to as CONSUMER). This agreement is based on the details of the address, identity, and communication information of the consumer provided during the login procedure.
Terms and Conditions
Payment and Reservation:
The consumer who buys accommodation via the website is required to immediately pay the total fee for the service. The reservation is not confirmed until the total payment is completed.Changes in Fee:
In the event of an increase in the agreement fee, the consumer will not be asked to pay the difference. Similarly, any deductions named “action” by YAŞMAK GROUP HOTELS will not be refunded to the consumer.Transfer of Reservation:
If the consumer cannot use the reserved accommodation, they may transfer the reservation to a third party who will fulfill all conditions and terms of the agreement, provided that YAŞMAK GROUP HOTELS is informed at least 7 days prior to the accommodation start date. Both the transferor and transferee are jointly and severally liable for the balance and additional charges arising from the transfer. YAŞMAK GROUP HOTELS will not accept responsibility if the consumer fails to obtain a visa, even if applied for, and will collect the full accommodation fee from both parties. If the transferee does not have the same status as the transferor, the transfer may not be executed.Changes and Cancellations by YAŞMAK GROUP HOTELS:
YAŞMAK GROUP HOTELS may change or cancel the reservation before or during the service due to reasons beyond the consumer’s control. The consumer may accept these changes or choose an alternative service. If changes are unacceptable, the consumer can cancel the reservation and receive a refund. In cases of force majeure (e.g., strikes, terrorism, or war), YAŞMAK GROUP HOTELS may cancel or postpone the reservation.Cancellation and Refunds by Consumer:
If the consumer cancels the reservation 2 days before the accommodation date, the fee will be refunded with no charge. Cancellations made later may result in a charge equivalent to 1 night. For non-refundable reservations, the fee will not be refunded. If a consumer requests a change in the service, they are required to pay the price difference immediately if the new service has a higher cost.Obligations of YAŞMAK GROUP HOTELS:
YAŞMAK GROUP HOTELS is responsible for providing the Pre-briefing Form/Voucher/Mail containing details on the service’s nature, sales price, and payment terms.Credit Card Payment:
If the service is purchased by credit card, the consumer is responsible for managing payments with the bank. If the consumer cancels a reservation made by installment, the refund will be processed by the bank, not by YAŞMAK GROUP HOTELS.Information Transmission and Responsibilities:
YAŞMAK GROUP HOTELS can transmit information to the consumer in written or permanent formats (e-mail, SMS, CD/DVD). The consumer is responsible for informing YAŞMAK GROUP HOTELS about any issues regarding the agreement’s execution within 30 days from the service date.Dispute Resolution and Jurisdiction:
Any disputes arising from this agreement shall be under the jurisdiction of the courts and arbitration committees of Istanbul. If any clause of the agreement becomes void, the remaining clauses will remain in effect.
This agreement is issued in compliance with the Code no. 6502 on Protection of Consumers and relevant legal provisions.
The consumer shall be deemed to accept the provisions of this agreement once it is signed or approved electronically.
